Bar fights are simply physical altercations that occur inside or on the premises of drinking joints. They are attributed to consumption of alcohol that may cause lower inhibitions and aggressive behavior in most people. These types of fights can be quite dangerous since they occur in small, enclosed places where a lot of people are present. Also, they may involve a group of people fighting and even using small weapons such as broken bottle or knife that can cause stabbing. You may have heard about lawyers suing bars for over serving alcohol.

Who is Held Liable for Bar Fights?

Liability for charges such as battery and assault can be difficult to determine. In most instances, it is the party that was aggressive that can be held liable for fight. However, the other party can equally be liable, depending on facts and circumstances.

Usually, different parties may be involved in a bar fight. This is the case when a security guard or bouncer is involved. However, the bouncer may not be liable if he or she was doing her duty within the acceptable limits. Unfortunately, if excessive violence or force is used to diffuse the fight, they can be held liable for the injuries caused.

In some cases, battery charges and criminal assault charges can result. If the prosecution decides to pursue criminal charges, this may result in consequences such as criminal fines and jail sentences. In some instances, aggravated assault may result is deadly weapons were used, or if one attacked a police officer.
